1. Acceptance of Terms

By accessing or using any services provided by Muzopilot LLC ("Muzopilot," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you may not use our services.

2. Service Description

Muzopilot provides managed business technology services including, but not limited to: professionally designed websites, mobile applications, digital smart cards with NFC and QR capabilities, AI-powered business tools, customer relationship management (CRM), invoicing and billing tools, analytics dashboards, and dedicated technical support. Our platform is designed to serve as a complete operating system for small and growing businesses.

3. Account Registration

To use Muzopilot services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account. You agree to notify us immediately of any unauthorized use of your account.

4. Service Plans & Billing

Muzopilot offers subscription-based service plans at various tiers. Each plan includes specific features, resource allocations, and support levels as described on our pricing page. Subscriptions automatically renew at the end of each billing cycle unless cancelled. Plan features, pricing, and availability are subject to change with at least 30 days' written notice to active subscribers. Any price changes will take effect at the start of the next billing cycle following the notice period.

5. Payment Terms

Payment is due at the start of each billing cycle. All payments are processed securely through Stripe. We accept major credit cards, debit cards, and ACH transfers where available. If a payment fails, we will attempt to charge the payment method on file up to three times. If payment remains unsuccessful after 7 days, your account may be suspended until the balance is resolved.

Refund Policy: New accounts are eligible for a full refund within 14 days of initial signup if you are not satisfied with the service. After the 14-day period, refunds are handled on a case-by-case basis through our support team. One-time setup fees and custom development work are non-refundable once work has begun.

6. Acceptable Use

You agree not to use Muzopilot services to:

  • Engage in any illegal, fraudulent, or harmful activity
  • Send spam, unsolicited communications, or bulk messages
  • Abuse, exploit, or misuse AI features for purposes other than legitimate business operations
  • Resell, redistribute, or white-label Muzopilot services without a Fleet plan or written authorization
  • Scrape, reverse-engineer, or attempt to extract source code from the platform
  • Upload malicious code, viruses, or content that could harm the platform or other users
  • Impersonate another person or entity
  • Violate the intellectual property rights of any third party

We reserve the right to suspend or terminate accounts that violate these policies, with or without notice depending on the severity of the violation.

7. Intellectual Property

The Muzopilot platform, including its software, design, branding, documentation, and underlying technology, is the exclusive property of Muzopilot LLC and is protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your business operations during your active subscription period.

8. Data Ownership & Portability

You retain full ownership of all content, data, and materials you upload, create, or store on the Muzopilot platform ("Client Data"). We do not claim any ownership rights over your Client Data. You grant us a limited license to use your Client Data solely to provide and improve our services to you.

You may request an export of your data at any time during your active subscription by contacting our support team. Upon account closure, your data will be retained for 30 days to allow for export, after which it will be permanently deleted from our systems unless required by law to retain it longer.

9. Service Level Agreement

Muzopilot targets 99.9% platform uptime, measured on a monthly basis excluding scheduled maintenance windows. Scheduled maintenance will be communicated at least 48 hours in advance and will be performed during off-peak hours whenever possible.

Support response times vary by plan tier. All plans include email support with responses within one business day. Higher-tier plans include priority support channels with faster response commitments as described in the plan details.

10. Smart Cards

Muzopilot smart cards are physical digital business cards equipped with NFC and QR code functionality. Cards are warranted against manufacturing defects for 12 months from the date of delivery. NFC and QR functionality depends on the recipient's device capabilities and is not guaranteed on all devices. Replacement cards for lost, stolen, or damaged cards may be ordered at the current replacement price. Custom card designs are subject to approval and production timelines.

11. AI Services

Muzopilot offers AI-powered tools as part of its platform, including content suggestions, workflow automation, and business insights. AI-generated content and recommendations are provided as suggestions only and do not constitute professional advice. You are responsible for reviewing, approving, and taking ownership of any AI-generated output before using it in your business operations. Muzopilot does not guarantee the accuracy, completeness, or suitability of AI-generated content.

12. Limitation of Liability

To the maximum extent permitted by law, Muzopilot LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of our services.

In no event shall our total liability to you for all claims arising out of or related to these Terms or your use of the services exceed the total amount of fees paid by you to Muzopilot during the twelve (12) months immediately preceding the event giving rise to the claim.

13. Termination

Either party may terminate the service agreement at any time. You may cancel your subscription through your account settings or by contacting our support team. Cancellation takes effect at the end of your current billing cycle, and you will retain access to the platform until that date.

Upon termination, you will have 30 days to export your data. Any outstanding balance for services rendered is due upon termination. We reserve the right to terminate accounts immediately for material violations of these Terms.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration administered in Raleigh, North Carolina, in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted by a single arbitrator, and the decision shall be final and binding on both parties.

15. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated to active subscribers at least 30 days before they take effect, via email or through the platform dashboard. Your continued use of Muzopilot services after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you may cancel your subscription before the changes take effect.

16. General Provisions

These Terms constitute the entire agreement between you and Muzopilot LLC regarding your use of our services. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision. These Terms are governed by the laws of the State of Florida.
